Weren't they struggling with the rights of the franchise when the made GG2 or something, hence only Sol/Ky?

That's true. The rights were tied up with Sammy, who published their games for a while.

It really isn't clear what the terms of this agreement were, as ASW was still able to make updates to the existing Guilty Gear games.

It's the exact same kind of thing that Platinum has going on with Sega right now. If they want to make a Bayonetta game, Sega has to be part of the deal. I think Sega owns all of Platinum's IP except for Metal Gear Rising, which Konami does.

I think you're right about Sol and Ky not being restricted by the license. ASW had been using them in cross-promotional stuff for years. MMO cameos particularly.
