Joke character? He has appeared in a lot of different Mario games. Nintendo, as far as I know, were the ones to assert that Birdo is a dude and has never tried to go back and say otherwise.
Edit: Oh, I guess they have called Birdo a girl in some games and a boy in others.

Nintendo pretty much doesn't even call any attention whatsoever to Birdo's gender.
If anything, if Birdo really is transgendered, isn't being treated the same as anyone else exactly what trans people have wanted all along? |

Nintendo characters don't have any backstory or bio beyond a few snippets in game manuals, I'm pretty sure. And those change routinely.

You do realize that Nintendo published a game in Japan where you have to get a vibrator from underneath Birdo's pillow to prove that she's female, right?
